Posteriormente, se hizo un análisis comparativo de estas regulaciones aplicando el método funcional del derecho comparado, identificando similitudes y diferencias entre las mismas. Finalmente, se encontró que las regulaciones existentes son diversas y se relacionan con el contexto donde se desarrollan. De esta manera, se encontraron similitudes y diferencias que permitieron proponer recomendaciones a tener en cuenta en la regulación de Colombia.
