the Constitutional Court by decree C 221 of 1994 decriminalized the size and consumption of the personal dose of hallucinogenic substances. Since then
constitutional jurisprudence has understood the use of these substances as a personal decision that should not be subject to censorship by the State or society
in order to safeguard the right to free development of personality. For its part
the Congress of the Republic has issued laws that typify the consumption of hallucinogenic substances as a police contravention
an issue that raises contradictions and uncertainties
in addition to opening the way to police and judicial arbitrariness. Given the problem raised here
two legal solutions are presented; One referring to the perpetuation of prohibitionism
and another that suggests the legalization of consumption. Prohibitionism proposes measures ranging from penalization to simple police reprimand. On the other hand
the proponents of the legalization demand to the legislator the legalization of the recreational use
and the regulation of the production and distribution of these substances. The rationale of the present investigation is to emphasize the effective guarantee of the rights and freedoms of the consumer. This undeniably implies even a transformation of the state's logic
since the flexibilization in the subject of the handling of the subject of drugs or hallucinogenic substances
demands the transfer of a repressive model to a more compassionate and comprehensive model
based on the respect and recognition of The human dignity.
