Summary: | This paper aims to investigate the legal situation and the real status of mining on indigenous lands, their environmental effects, and the eventual legal consequences of deregulating this activity. First, the constitutional provision and the importance of regulating mining on indigenous lands are presented. Then, the position of the Federal Government on mining on indigenous lands is discussed. Third, it explains the Garimpos on indigenous lands in the Amazon and their status under the law and the Federal Constitution. Finally, it addresses the inappropriate use of an environmental good, classified as a common good, according to the Federal Constitution. |
