description La ley colombiana determinaba que los padres debían registrar a sus hijos asignándoles como primer apellido el de su padre. En noviembre de 2019, la Corte Constitucional precisó que tal regla viola la igualdad de géneros y permitió a los padres asignar a sus hijos como primer apellido bien sea el paterno o el materno. Este texto investigativo, con metodología basada en teoría de juegos y en modelos del análisis económico de derecho de familia para aplicarlos, lege lata, a las nuevas normas que permiten a los padres negociar entre sí sus derechos de propiedad sobre los apellidos de sus hijos, haciendo énfasis en padres casados o en unión libre. El texto también estudia dicha negociación bajo los modelos de batalla de los sexos y del juego de la gallina. Tal enfoque ofrece nuevas perspectivas no solo sobre los efectos de la reciente jurisprudencia sino también sobre el análisis económico del matrimonio y del derecho de familia. El texto concluye que: la negociación de los apellidos será compleja no por razones legales sino económicas, como el monopolio bilateral existente entre los padres y el ser un apellido un objeto indivisible que no se comercia en un mercado tradicional.

In November 2019, Colombian Constitutional Court held that such rule was against the equal treatment of genders, allowing parents to register a child either with the father’s or the mother’s surname. This research, based on a game-theoretical approach as well as on models of the economic analysis of family law, applies such notions, lege lata, to the new rules allowing parents to bargain over property rights on their children’s last names, focusing on married parents or in those who live together under similar arrangements. The paper also models such bargaining as both a battle of the sexes and a chicken game. Such approach offers new insights not only as to new case law’s effects but also, and more generally, regarding the economic analysis of marriage and other family law issues.
