description A través del análisis de un instrumento del derecho sancionatorio ambiental de Estados Unidos, los Supplemental Environmental Projects(SEP), se plantea que la incorporación de reglas y criterios de justicia ambiental en el diseño regulatorio de las potestades e instrumentos de fiscalización, sanción y cumplimiento trae como consecuencia la posibilidad de abordar la desproporción en la distribución de las cargas, riesgos e impactos ambientales provenientes del incumplimiento de la normativa ambiental. Específicamente, se identifican como criterios de justicia ambiental presentes en estos proyectos, los de adicionalidad ambiental, remediación del medio ambiente, identificación y cercamiento de las víctimas y de los infractores, y el de la ciudadanía como colaboradora en la fiscalización y en la definición de los sep.
