The research aims to formulate the theoretical and practical budgets to be carried out to recognize the insuperable exculpation of fear. It is necessary to determine it according to the concurrent c ircumstances, then it corresponds to demand to the subject to act in a different way to how it was done. As a result theoretical and practical budgets are gotten, to recognized the insuperable exculpation of fear as an inexigibility cause of penal responsi bility. It contributes to a correct regulation of the insuperable exculpation of fear with a level of inexigibility in which no corresponds to demand to the subject to act in a different way of how it was done.La eximente del miedo insuperable ha sido objeto de disímiles controversias. En algunos casos la ley es contradictoria, y lo expresado trasciende a la práctica judicial cubana en la que existe indeterminación al momento de apreciarla y en ocasiones la confunde con otras eximentes. Por ello es propósito de la investigación formular los presupuestos teóricos prácticos que han de concurrir para que se pueda reconocer la eximente del miedo insuperab le. Se hace necesario determinar si debido a las circunstancias concurrentes corresponde exigirle al sujeto que actuara en forma distinta a como lo hizo. Como resultados de la investigación se obtienen los presupuestos teóricos prácticos que han de darse p ara que se pueda reconocer la eximente del miedo insuperable, como una causa de inexigibilidad de la responsabilidad penal.
