Therefore, it is difficult to sa tisfy fully the quest for truth in a judicial opinion because it depends on variables that cannot be controlled by those who participate in the proceedings. Thus, assessing evidence involves a confrontation of personal interests and it is in turn dependent upon the reconstruction of facts in a legal process.El presente trabajo pretende analizar las dificultades teóricas, fácticas y legales que se derivan de asumir el proceso judicial en términos epistemológicos. El carácter de los hechos en la relación jurídico - procesal está determinado por las pretensiones de las partes, las exigencias del proceso y el fin de la prueba; por tanto, la búsqueda de la verdad es un propósito difícil de satisfacer de modo pleno en la decisión judicial porque depende de variables no controlables por los sujetos procesales.
