Collectively, these rules are called the international labor regim e. In this context, maternity leave stands as a social and economic policy that is part of the international system, but because of its relation to the protection of the rights of working women and children’s fundamental rights, it has been developed throu gh multiple legal instruments, which have been approved by the Colombian state. Thus, in Colombia, maternity leave has been recognized since the Constitution of 1991 was passed. Since then, its development in the domestic legal order has been mainly throug h the rulings of the Colombian Constitutional Court.En materia laboral y de seguridad social, las normas internacionales de trabajo expedidas por la OIT constituyen el marco normativo a nivel internacional que, en consonancia con diversos tratados de protección de los derechos humanos, consagran los derechos de los trabajadores y sus garantías mínimas, lo que se denomina el régimen internacional laboral. En ese contexto, la licencia de maternidad se erige como norma social y económica en dicho régimen del sistema internacional, y es una que, en virtud de su relación con la protección de los derechos de la mujer trabajadora y con los derechos fundamentales de los niños, ha logrado todo un desarrollo a través de múltiples instrumentos normativos, los cuales han sido aprobados por el Estado colombiano.
