The thesis proposed by the first determinists and the subsequent schools, whose theories were based on freedom and free choice, will be exposed from the historical recapitulation. Furthermore, this paper will address the American studies that base criminality on social, economic, and environmental aspects of the subject, always taking as starting point the human free will. Having considered surpassed the theories of Lombroso, Garófalo, and Ferri this paper will demonstrate, from natural sciences such as medicine and particularly neurology and forensic psychiatry, how the positivist principles could be relevant now and have an actual scientific basis. From the foregoing, this paper intends to give validity to the deterministic hypothesis that eliminate free will and consider that the offender does such conducts not because they chose to but because something bigger than them orders them to do so.En el presente artículo se aborda la evolución del estudio de la criminología y las causas de la delincuencia, partiendo de los clásicos positivas italianos hasta los más actuales debates cuya base se encuentra en la neurociencias. A partir del recorrido histórico se expondrá la tesis esgrimida por los primeros deterministas, y las escuelas posteriores que plantearon teorías debidamente sustentadas a partir de la libertad y la libre elección del sujeto. Se expondrán los estudios estadounidenses que basan la criminalidad en aspectos sociales, económicos y del entorno del sujeto, tomando como punto de inicio siempre el libre albedrío humano. Habiéndose considerado superadas las teorías de Lombroso, Garófalo y Ferri, se demostrará cómo a partir de ciencias naturales como la medicina, en especial la neurología y la psiquiatría forense, pueden cobrar vigencia los principios positivistas y esgrimir un sustento científico.
