As part of the peace talks, the government allowed political participation to former members of the guerrilla, through a political party called “Propuestas por la Paz”, which elected Aura Bonilla as Congresswoman and Elizabeth Guzmán as the mayor of the capital. Overthrowing and subsequent inability of both women, made by the state ́s General Solicitor, antagonize with the most basic standards on political rights and restricts the cornerstone of the due process of law: the double jeopardy clause. The following lawsuit approaches the problem through the case law of the Inter-American Human Rights Court, taking special care of the institutional design of the State of Sarapoa, and the establishing the international responsibility for it.Tras un proceso de Justicia Transicional, los diferentes actores armados presentes en el Estado de Sarapoa dejaron las armas y se reincorporaron a la vida civil. Como parte de las negociaciones de paz, se permitió la participación política a ex militantes de los grupos guerrilleros, consolidados en el movimiento político “Propuestas por la Paz”, por el cual resultaron elegidas Aura Bonilla, como senadora de la república, y Elizabeth Guzmán, como alcaldesa de la capital. La destitución y posterior inhabilidad de ambas funcionarias, a manos del Procurador General de la Nación, contraría los más básicos estándares en materia de limitación de derechos políticos y vulnera flagrantemente una de las más elementales garantías del debido proceso legal: el non bis in ídem.
