Although it deals with obvious and fundamental aspects of legal argument, well-known to legal experts and professionals in law, it offers suggestions and key explanations about how to prepare a claim, presented in a brief and straightforward way, so that interested parties may have access to them, discuss them, and adapt them to their necessities and interests. Its main topic is the argument in natural language, and the question is: How is a case argued in court? The central thesis is: Legal argument implies a reasonable or practical dimension which does not come down to purely rational argument or formal logic. To argue reasonably implies more than simply observing a logical structure of reasoning. Arguing presupposes the observation of practical conditions that make possible an intelligible and successful argument.El artículo nace del trabajo pedagógico en seminarios y cursos de Lógica, Argumentación, Derecho y Filosofía del Derecho. Su propósito es, básicamente, pedagógico: busca aportar al desarrollo de la competencia argumentativa y la capacidad para analizar críticamente la argumentación jurídica. Aunque trata de aspectos obvios y elementales sobre la argumentación jurídica, muy conocidos por los juristas y profesionales del derecho, presenta sugerencias y explicaciones claves sobre como fundamentar una demanda (claim), presentadas de manera sencilla y breve, para que los interesados en estos asuntos puedan acceder a ellas, discutirlas y adecuarlas a sus necesidades e intereses. Su tema eje es la argumentación en lengua natural y la cuestión que aborda es ¿Cómo argumentar un caso frente a un tribunal? La tesis central es: la argumentación jurídica implica una dimensión razonable o práctica que no se reduce al argumento puramente racional o lógico formal. Argumentar razonablemente implica algo más que observar la estructura lógica de un razonamiento.
