El objetivo principal es explorar la protección de datos en Colombia, contextualizando el dato personal en el derecho patrimonial y evaluando la aplicabilidad de la teoría del negocio jurídico en transacciones de datos. Se establecen principios y conceptos fundamentales del tratamiento de datos, delineando derechos y obligaciones de los responsables. El enfoque se intensifica en procedimientos proteccionistas para resguardar la intimidad de los titulares. Se aborda el dato personal desde la perspectiva del derecho patrimonial, explorando su definición, contenido y límites, determinando su posible consideración como bien intangible y parte del patrimonio del titular. Se examina la aplicabilidad de la teoría del negocio jurídico y su relación con el derecho patrimonial, así como teorías aplicadas a la comercialización de datos. Se destacan implicaciones éticas y se subraya la posibilidad de negocios jurídicos que benefician al titular, enfocándose en el contrato como medida de protección de la intimidad. Se identifican perspectivas a favor y en contra de la comercialización de datos. Este estudio contribuye a la comprensión del marco legal colombiano en la comercialización de datos, abordando aspectos claves que vinculan la privacidad con el contexto patrimonial y transacciones jurídicas.

The main objective is to explore data protection in Colombia, contextualizing personal data within property law and evaluating the applicability of the legal transaction theory in data transactions. Fundamental principles and concepts of data processing are established, outlining the rights and obligations of those responsible. The focus intensifies on protectionist procedures to safeguard the privacy of data subjects. Personal data is addressed from the perspective of property law, exploring its definition, content, and limits, determining its possible consideration as an intangible asset and part of the owner's assets. The applicability of the legal transaction theory and its relationship with property law are examined, as well as theories applied to data commercialization. Ethical implications are highlighted, emphasizing the possibility of legal transactions benefiting the data subject, focusing on the contract as a measure to protect privacy. Perspectives in favor and against data commercialization are identified.
