Lo anterior bajo un diseño de investigación de trabajo de campo, de tipo jurídica-exploratoria el cual se desarrolla en los despachos civiles del circuito del municipio de Tuluá, Valle del Cauca. El cual arroja como resultados la identificación de las fortalezas: Protección del crédito, recuperación paulatina, conservación y continuidad de las actividades empresariales, y libertad por parte del deudor para proponer a sus acreedores un acuerdo y formas de pago según su estrategia financiera para recuperarse. Como debilidades de la Ley 1116 de 2006: la falta de conocimiento en general de la norma por las partes (deudor-acreedores); que no se puede iniciar proceso por no haber cumplido obligaciones laborales con sus empleados o por no cumplir con el tiempo de mora con acreedores establecido en la ley; la necesidad que tiene el deudor de contratar persona o entidad especializada en asesoría financiera que trace las estrategias y le planee un buen análisis financiero que permita recuperar la empresa y cumplir con los acuerdos y formas de pago. Así mismo esta investigación indica la estadística sobre los procesos de reorganización y/o procesos de liquidación judicial en el Municipio de Tuluá, Valle del Cauca, año 2010 -2018 y los beneficios y las dificultades de los mismos.Abogado (a)PregradoThis degree work proposes to analyze the business insolvency regime, Law 1116 of 2006 and its impact on the individual merchant in the municipality of Tuluá, Valle del Cauca, 2010-2018. The foregoing under a fieldwork research design, of a legalexploratory type, which is developed in the civil offices of the municipality of Tuluá, Valle del Cauca. Which results in the identification of strengths: Credit protection, gradual recovery, conservation and continuity of business activities, and freedom on the part of the debtor to propose to their creditors an agreement and forms of payment according to their financial strategy to recover. As weaknesses of Law 1116 of 2006: the general lack of knowledge of the norm by the parties (debtor-creditors); that a process cannot be initiated for not having fulfilled labor obligations with its employees or for not complying with the time of arrears with creditors established by law; the need for the debtor to hire a person or entity specialized in financial advice to draw up the strategies and plan a good financial analysis that allows the company to recover and comply with the agreements and forms of payment.
