La investigación es de diseño documental, como base de la investigación jurídica. Así mismo, de acuerdo con los objetivos específicos esta investigación es de tipo descriptivo, con tres capítulos: 1). Ponderación entre justicia y paz como principios constitucionales para la existencia de tribunales de Justicia Transicional. 2). El establecimiento de la JEP en Colombia. 3) Desarrollo y proceso actual de los delitos competencia de la JEP y en particular el proceso adelantado para el delito de las ejecuciones extrajuicio. La investigación permite concluir que la Jurisdicción Especial de paz en Colombia ha sido la esperanza para la lograr la Justicia, aunque actualmente existen cantidad de hechos por los cuales la JEP tiene un gran reto de lograr la justicia para las víctimas, se evidencian avances en los siete grandes macrocasos, si bien, hay que tener fé en que la JEP hará lo correspondiente en su sala de reconocimiento de la verdad, por ahora en el Macrocaso No. 3 (Muertes ilegítimamente presentadas como bajas en combate por agentes del Estado) solo en Antioquia se denota avances significativos en su primera fase investigativa, siendo el auto 033 de 2021 significante de un esfuerzo en la concentración de las 6 zonas, en las cuales se cometieron tantas injusticias contra 6.402 personasThis monograph analyzes the development and process of the Special Justice for Peace in Colombia, through a qualitative approach, under the deductive research method (general to particular). The research is of documentary design, as a basis for legal research. Likewise, according to the specific objectives, this research is descriptive, with three chapters: 1). Weighting between justice and peace as constitutional principles for the existence of Transitional Justice courts. 2). The establishment of the JEP in Colombia. 3) Development and current process of crimes under the jurisdiction of the JEP and in particular the process advanced for the crime of extrajudicial executions.
