Para lo cual se hace necesario el brindar las garantías imperantes para que, en el marco del contexto colombiano, el modelo de justicia transicional coadyuve al cumplimiento de los fines del Estado, encaminado a la preservación del orden y la consolidación de una paz estable y duradera. La metodología empleada es hermenéutica analítica cualitativa, toda vez que se hace un análisis interpretativo sobre los conceptos de la justicia transicional, su aplicación en el nuevo proceso de paz en el marco del Acuerdo para la Terminación del conflicto armado de 2016, donde establece la jurisdicción especial para la paz y el cumplimiento de los fines de reparación integral de las victimas nuevamente como eje fundamental para finalizar el conflicto.Especialista en Derecho ConstitucionalEspecializaciónThe present work consists of a look at the foundations under which the Colombian Constitutional Court found the model of transitional justice applied in Colombia viable and legitimate, this, through the jurisprudential precedent, where the central axis of the argument is based on the need to provide an effective response with restorative elements for the victims, recognizing them as subjects of rights, seeking the fulfillment of objectives with the highest degree of satisfaction and turning the Colombian model into a tool designed for the victims and society in general. For which it is necessary to provide the prevailing guarantees so that, within the Colombian context, the transitional justice model contributes to the fulfillment of the purposes of the State, aimed at the preservation of order and the consolidation of a stable and lasting peace.
