Ahora bien, el derecho de autor existe porque cubre la necesidad de que haya un reconocimiento de una creación intelectual y una retribución de índole económica, amparando al autor desde el instante en que crea su obra, concediéndole dos clases de derechos: morales y patrimoniales. Los primeros son perdurables en el tiempo, no se pueden transferir e irrenunciables permitiéndole al autor en todo momento reclamar la invención de la obra, y enfrentarse a quien quiera modificarla, deformarla o menoscabarla, y conservarla inédita; aunque, él puede modificarla o retirarla del mercado. En cuanto a los segundos, son los facultados exclusivamente para efectuar, permitir o impedir que la obra sea reproducida, distribuida al público, importada, traducida o que se le haga alguna modificación o transformación.
