Esta revisión, permitió identificar una postura garantista del derecho de los estudiantes, dejando claro en múltiples momentos que las aulas de clase, no solo deben ser el lugar en el que los estudiantes obtengan conocimientos teóricos y prácticos, sino que también deben ser el espacio para que los estudiantes formen, fortalezcan y expongan con seguridad el desarrollo propio de su personalidad. No obstante, pese a la falta de unificación jurisprudencial existente, las instituciones educativas tanto de carácter público como privado desconocen los lineamientos propios de este derecho y afecta, a través de sus manuales de convivencia, así como de sus resoluciones y otros actos administrativos institucionales, este derecho de los estudiantes.Abogado (a)PregradoWe reviewed the manuals of conduct of two public educational institutions in the center of Valle del Cauca, one in Tuluá and the other in Guadalajara de Buga, in order to determine in them the consideration of the free development of personality in accordance with the broad jurisprudence of the Constitutional Court in this regard. This review made it possible to identify a posture that guarantees the right of students, making it clear at multiple moments that classrooms should not only be the place where students obtain theoretical and practical knowledge, but should also be the space for students to form, strengthen and safely expose the development of their own personality.
