La forma en que se desarrolla el tema en cuestión es a través de varios objetivos, como: definir la culpa patronal, los elementos que caracterizan esta figura y diferenciarlas de otras figuras que son similares y pueden llegar a confundir a las personas y establecer en qué casos no opera esta figura y los tipos de responsabilidad del empleador, que tipo de perjuicios debe pagar el empleador al trabajador por su falta de cuidado con los instrumentos, máquinas y elementos que le proporciona al trabajador para que desarrolle las actividades para la cuales fue contratado, todo lo anterior con el fin de esclarecer y desmenuzar de la mejor forma posible el tema. Para el desenvolvimiento de la culpa patronal y su aplicación se usaron los documentos físicos y electrónicos, libros, jurisprudencia y métodos como la entrevista, este último para especificar la aplicación de la culpa patronal en las empresas de los municipios de Andalucía y Bugalagrande y el conocimiento y/o uso que los empleadores de las fábricas de gelatina (Andalucía) y la empresa Nestlé (Bugalagrande) puedan estar ejerciendo. Finalmente con toda la información recolectada se le dio un desarrollo a los objetivos trazados al inicio del trabajo y a base de esto se desarrollaron varias conclusiones a las que llegamos luego de todo el proceso narrado anteriormente.Abogado (a)PregradoThe work done on employers' liability, begins with a historical and conceptual journey, with the aim of establishing the criteria to be used under Colombian law for their application in the different events in which an occupational accident or disease occurs; and to know whether those criteria are being applied in the correct way, to prevent arbitrariness or abuse of both the worker and the employer. The way in which the topic in question is developed is through several objectives, such as: define the employer’s fault, the elements that characterize this figure to differentiate it from others that are similar and for that reason can confuse people. Also, establish in which cases this figure does not operate, and the types of liability of the employer; what type of damages the employer must pay to the worker for his lack of care with the instruments, machines and elements that he provides to carry out the activities for which he was hired. All the above in order to clarify the issue in the best way. Physical and electronic documents, books, case law and methods such as the interview were used for their application, the latter one in order to specify the application and development of employer’s liability in companies in the municipalities of Andalucia - Bugalagrande and the knowledge and/or use that the employers of the gelatin factories (Andalucia) and the company Nestlé (Bugalagrande) may be exercising.
