Cuando se pierde esta condición de dignidad, el sujeto ya no es merecedor de la confianza de su electorado, por lo tanto, no debe seguir representando los intereses de los mismos. Para corregir esto, el marco normativo colombiano estableció las condiciones, causales y procedimientos para hacer efectiva la figura de pérdida de investidura, tanto de congresistas, como de diputados, concejales municipales y distritales y de miembros de juntas administradoras locales. En el marco normativo colombiano, se considera la investidura como un cargo público, por tal motivo, la perdida de la misma es asimilado como un proceso sancionatorio de carácter disciplinario, en donde, las instancias correspondientes deberán aplicar las normas establecidas para tal fin a los trabajadores oficiales y funcionarios públicos. En el caso de estudio, se abordaron todas las normas referentes a la perdida de investidura existentes en Colombia, así como su jurisprudencia aplicada, en especial para el caso de pérdida de investidura de concejales por violar el régimen de conflicto de intereses. Para ellos, los autores estructuraron el mismo en tres capítulos, referentes a dar respuesta al planteamiento del problema y así lograr o alcanzar los objetivos específicos de la investigación. Estos capítulos se identificaron de la siguiente manera: • Regulación y principales elementos de la figura jurídica denominada, perdida de investidura respecto al conflicto de intereses. • Fundamentos de la primera instancia, en el caso de pérdida de investidura del concejal correspondiente al momento de emitir la decisión, y • Valoración de la sentencia de primera instancia, en el caso de pérdida de investidura del concejal; conforme o no a la postura del Consejo de Estado.Abogado (a)PregradoInvestiture is considered a condition of dignity and honor that is granted to a dignitary to represent a significant group of citizens who have placed their trust in him through voting at the polls. When this condition of dignity is lost, the subject is no longer worthy of the trust of his electorate; therefore, he should not continue to represent their interests. To correct this, the Colombian regulatory framework established the conditions, grounds and procedures to make effective the figure of loss of investiture, both of congressmen, as well as deputies, municipal and district councilors and members of local administrative boards. In the Colombian regulatory framework, the investiture is considered a public position, for this reason, the loss of it is assimilated as a disciplinary sanctioning process, where the corresponding instances must apply the rules established for this purpose to the official workers and civil servants. In the case study, all the norms referring to the loss of investiture existing in Colombia were addressed, as well as its applied jurisprudence, especially in the case of loss of investiture of councilors for violating the conflict-of-interest regime.
