Para esto, se estableció, primeramente un abordaje desde el método histórico, para entender la evolución normativa de la posición del contratista con el Estado, para después, desde la metodología con enfoque descriptivo, recopilar y presentar todos los hallazgos a los que hubo lugar en la revisión bibliográfica y jurisprudencial nacional como extranjera, que nos permitieron realizar bajo, el método lógico, una confrontación directa con los principios y estructura legal de la contratación pública, donde, finalmente se concretó, bajo el método deductivo, si lo dispuesto en el artículo 3 de la Ley 80 de 1993, modificado por el artículo 32 de la Ley 1150 de 2007, sigue siendo exigible y económicamente beneficioso, frente a los derechos inicialmente estudiados.Abogado (a)PregradoThis monograph focused on the study of the legal guarantees of the Contractor vis-à-vis the Colombian State, in relation to the position of the former as an agent entitled to the rights of economic freedom, private property, enterprise and private initiative in business or contractual relations held to materialise the purposes of the State.
