De esa premisa parte el trabajo de investigación, que giró en un enfoque cualitativo, descriptivo y argumentativo, fundamentado en aspectos teóricos contenidos en el diseño bibliográfico, donde se analizaron desde diferentes concepciones jurídicas, por una parte el concepto de fuero de maternidad y por otra la carga probatoria y su inversión. La sentencia SU-075 del 2018, por ser una decisión del máximo tribunal de la justicia constitucional se hizo imperativo identificar bajo el principio de proporcionalidad si la Corte Constitucional incurrió en el desconocimiento de la garantía del fuero de maternidad y la inversión de la prueba sin tener en cuenta el juicio de igualdad desconociendo la supremacía constitucional.Abogado (a)PregradoIn the previous legal study a critical analysis is made, under the general objective of establishing whether the reinforced occupational protection of maternity is unknown, analyzing if the burden of proof is reversed to a disadvantage of the worker if she is fired during the last two months of the lactation period, in judgment SU-075 of 2018. this premise research work starts, turned on a qualitative, descriptive and argumentative approach, based on theoretical aspects contained in the bibliographic design, where they were analyzed from different legal conceptions, the concept of maternity jurisdiction and, on the other, the burden of proof and its investment.
