De ahí que el propósito de este trabajo sea el de mostrar que los derechos naturales no son un asunto de “hechiceros” o “gurús” y que, es posible realizar una defensa lógica y consistente de ellos. Pero, ¿De qué clase de derechos estamos hablando? De la autopropiedad y los derechos de propiedad privada. Se demostrará que estos derechos son axiomas indiscutibles y necesarios, impresos en la propia naturaleza del hombre y de las cosas. A partir de aquí, esta visión en general será contrastada con dos de las más importantes tesis opuestas, a saber, la propuesta de los derechos positivos tal y como ha sido expuesta por Lorenzo Peña, y la tesis de los derechos samaritanos planteada por Nicolás Maloberti. Ambas, serán analizadas, se cuestionará su justificación y su exigibilidad."Nonsense upon stilts" was the name that Jeremy Bentham gave to natural rights, a branch of ethics that, unfortunately, is not highly appreciated these days. Hence the purpose of this work is to show that natural rights are not a matter of 'sorcerers' or 'gurus' and that, is possible to make a logical and consistent defense of them. But, what sort of rights are we talking about? The self-ownership and private property rights. It will be demonstrated that these rights are indisputable and necessary axioms engraved in the very nature of Man and things. From here, this vision in general will be contrasted with two of the most important opposing theses, namely, the proposal of positive rights as it has been exposed by Lorenzo Peña, and the samaritan rights thesis proposed by Nicolás Maloberti.
