description Este artículo surgió como un ejercicio académico para la asignatura de propiedad intelectual del programa de Derechode la Corporación Universitaria Remington, bajo parámetros de congruencia entre los límites de los derechos con lavoluntad personal del autor, en su primera parte se logra un acercamiento a otra posibilidad de garantizar los derechosde autor bajo la ideología de la autonomía personal en la propiedad privada, utilizando como camino discursivo elanálisis de un documental difundido virtualmente; en la segunda se realiza un estudio desde la penalización en unsistema procesal determinado que impone la restricción en las posibilidades de negociar los derechos relacionados conpropiedad intelectual; ambas etapas del ensayo motivan la reflexión sobre el alcance de la distinción de la creaciónintelectual como propiedad privada sin mayores restricciones que los que su autor le incorpora o como un derechoobjeto de límites legislativos.Palabras clave: autonomía de la voluntad, politica criminal, propiedad intelectual, sistema procesal.
