description Los inconvenientes que se evidencian en Colombia tras la imposición de sanciones administrativas a los extranjeros por incumplir sus obligaciones, estas regidas por el procedimiento administrativo general de la Ley 1437 de 2011, el cual presenta diversas etapas y términos, ocasionan dilatadas decisiones comitentes de la permanencia irregular de extranjeros, lo que avoca en la necesidad de fijar un procedimiento especial que viabilice al respecto. Por ende y en relación al enfoque investigativo cuantitativo y cualitativo, se recolectó información determinante para evidenciar el aumento de flujos y fenómenos migratorios que aúnan en el incumplimiento de la normatividad, lo que permitió el empleo metódico sistemático para la comparación y análisis de información, sobre el objetivo de conocer la efectividad en la aplicación del actual procedimiento, que conduzca a evidenciar sus deficiencias bajo la necesidad de implementar uno de tipo especial que permita afianzar y efectivizar el cumplimiento de las obligaciones migratorias.
