El presente documento aborda el tema de la minería en Colombia desde las disposiciones normativas diseñadas para el ejercicio de esta actividad, en contraste con la jurisprudencia de las altas cortes, al respecto de la defensa del medio ambiente, considerando al respecto, que si bien las autoridades estatales encargadas de regular la materia minera en el país, han expedido un acervo considerable de normatividad, esta se ha guiado más hacia la seguridad jurídica de las licencias y contratos de concesión que por vía administrativa y en cumplimiento de los principios constitucionales del ejercicio administrativo se entrega a particulares, que hacia la valoración significativa de la defensa del medio ambiente, fundamentalmente en defensa del principio de precaución, esto, por la misma necesidad que el Gobierno ha creado sobre la minería, que al ser un rubro estratégico en la productividad del país, se ha definido como locomotora dentro de los planes económicos del actual gobierno. |
