Abordará la jurisprudencia en aras de determinar las premisas de la línea que se ha trazado, con sustento en decisiones que demuestran como se ha ampliado el espectro en los eventos que le son propios a privación injusta de la libertad, que poco a poco se cimenta, y se ha convertido en responsabilidad objetiva.This article shall analyze the figure of the state responsibility stated in the 90th article of Colombia´s constitution in the frame of the state council´s case law, which has had remarkable variations during this last decade, punctually on what occurs with reparation sues, under to various events which befall in the penal process, in which liberty privation has happened, and which had not ended in conviction verdicts.It shall approach the case law willing to determine the premises of the line it has marked, sustaining itself on decisions which show how the spectrum on events related to unfair liberty privation has enlarged, which gradually cements itself, and has become into objective responsibility.pdfapplication/pdfspaspaUniversidad Militar Nueva GranadaFacultad de DerechoEspecialización en Procedimiento Penal, Constitucional y Justicia MilitarDerechos Reservados -
