El principal objetivo del proceso disciplinario en Colombia se ciñe a la necesidad de buscar, investigar y sancionar las conductas que atentan contra el buen funcionamiento del Estado y el cumplimiento de los deberes funcionales de los Servidores Públicos en general y aquellos particulares que transitoriamente cumplen funciones públicas. De acuerdo a la normatividad que regula el proceso disciplinario en Colombia y a diversos pronunciamientos de las Altas Cortes del país, es indudable la dimensión que representa el Principio de Investigación Integral, ya que, en el desarrollo del proceso disciplinario y la búsqueda de la verdad real y material de las conductas (por acción u omisión) que desarrollen los destinatarios de esta disciplina es de gran relevancia, la disposición de la autoridad disciplinario al momento de investigar con igual grado de intensidad tanto lo favorable como lo desfavorable al disciplinado, por consiguiente, el juez disciplinario en el momento de tomar una decisión debe contar todos los elementos de convicción posibles que le permitan llegar a una reconstrucción histórica verdadera, garantizando así mismo el acatamiento del debido proceso consagrado en nuestra Carta Política. |
