description El presente artículo analiza las garantías judiciales previstas en los artículos 8 y 25 de la Convención Americana sobre Derechos Humanos a la luz de la jurisprudencia de la Corte Interamericana de Derechos Humanos. De acuerdo con los antecedentes que se han presentado en Colombia, en relación con los mecanismos que emplea el aparato jurisdiccional frente a las garantías judiciales. El análisis jurisprudencial y normativo vigente se constituye de referente interpretativo o hermenéutico a fin de resolver las dificultades que se presenten al ventilarse el asunto subjudice ante la competencia de la Corte Interamericana de Derechos Humanos.
