Summary:This paper seeks to participate in the discussion on how P2P lending should be regulated in Colombia. We propose that P2P lending platforms should be subject to their own regulation, which takes into account the particularities of their business models, because these are different from those present in the banking and securities market. To support this claim, first, we show that P2P lending platforms are not banks and, thus, should not be subject to their regulations. Secondly, we argue that debtors that participate in P2P lending should not be subject to the mandatory disclosure rules present in securities markets because the risks that are present in them are not present in P2P lending or, at least, not in the same degree...
