Description
Summary:The direct revocation of particular and concrete administrative acts has often generated questions within the legal community because of the two opposite positions that differ in the application of the legal institution; on the one hand, those that assume that favorable administrative acts are revocable do not reflect on the fact that the this effect harms legal certainty, on the other hand, those that consider that all administrationïs decisions are irrevocable do not think about the consequences that for the legal order has an immutable administrative act cumbersome for the public interest and obtained through illegal or fraudulent ways. In this context, it is necessary to regulate an intermediate legal way whereby the administration, under the principles of due process and legitimate expectations, can directly revoke particular and concrete administrative acts issued due to illegal or fraudulent acts.
