Firstly, not acknowledging it implies that rights are taken to be means that may be sacrificed in order to achieve a common aim. Secondly, not acknowledging this distinction implies denying that rights are derived from some dimension of morality, therefore challenging the claim that hard cases may be decided objectively and that there are right answers to legal questions.--Tomado del Formato de Documento de Grado.La preocupación por la naturaleza de los derechos es central para las teorías de la adjudicación contemporáneas. En el marco del debate entre Richard Posner y Ronald Dworkin, vale la pena preguntarse por las implicaciones que tiene trazar una distinción entre derechos y fines colectivos. No reconocer la diferencia entre derechos y fines colectivos, en primer lugar, lleva a considerar que los derechos son simplemente medios que pueden ser sacrificados en aras de la consecución de un fin común.
