With this in consideration, it is important to be careful when assessing the extent to which a State can use its citizens' data to implement various public policies. Thus, this text aims to answer the research question regarding to what extent the public policies proposed by the Draft Bill 021 of 2020 from the House of Representatives and the CONPES documents 3920 of 2018 and 3975 of 2019 allow to face the legal and ethical challenges generated by the implementation of artificial intelligence, preserving the Social Rule of Law?.La recolección de datos ha permitido un gran avance en la tecnología, más específicamente en el campo de la Inteligencia Artificial. Sin embargo, aún en Colombia no se han adoptado marcos normativos y éticos vinculantes que respondan de manera directa a la implementación de la IA en el sector público. Ante este panorama es pertinente ser cuidadoso al momento de evaluar hasta qué punto un Estado puede servirse de los datos de sus ciudadanos para implementar diversas políticas públicas.
