Summary:Data collection has allowed a substantive breakthrough in technology, specifically in the field of Artificial Intelligence. However, Colombia has not adopted binding regulatory and ethical frameworks yet that respond directly to the implementation of AI in the public sector. With this in consideration, it is important to be careful when assessing the extent to which a State can use its citizens' data to implement various public policies. Thus, this text aims to answer the research question regarding to what extent the public policies proposed by the Draft Bill 021 of 2020 from the House of Representatives and the CONPES documents 3920 of 2018 and 3975 of 2019 allow to face the legal and ethical challenges generated by the implementation of artificial intelligence, preserving the Social Rule of Law?.
