APROBADO ACTA NRO.124, en esta decisión menciona la negativa de otorgar alimentos al excónyuge por considerar que este no era un sujeto pasivo del tipo penal y asegurar que de entenderse lo contrario se estaría ante la analogía in malam partem. Al respecto el documento hace un ejercicio por estudiar el bien jurídico familia y la teoría del delito para concluir que contrario a lo que afirmó la Corte Suprema de Justicia, el cónyuge divorciado, culpable o en proceso de divorcio se encuentra recogido dentro del tipo penal de inasistencia alimentaria pues la interpretación analógica penal lo permite, sin que esto configure una analogía.
