Summary: | The diffuse constitutionality control system supported by the 1991 Political Constitution, although with considerable antecedents since the creation of the Colombian Council of State in 1913, meant the deconcentration of the guardianship function of the superior text, allowing the inclusion of different bodies with sufficient powers to exercise it. However, and in particular with regard to the action for annulment due to unconstitutionality as an application mechanism of the diffuse control of constitutionality at the head of the Contentious-Administrative Jurisdiction, the clause that regulates this control model (Article 237-2 of the Constitution) has turned out to be a dead letter. This is due to the deviant interpretation given by the Council of State and the Constitutional Court, in part caused by a confusing legislative regulation around the figure of nullity due to unconstitutionality.
