Summary: | This paper focuses on a legal analysis of the guarantee of minimum pension for demobilized persons contained in article 147 of Law 100 of 1993. Research is focused on carrying out a study of the validity of the norm to grant guidance elements which make it possible to establish whether or not the rule was abolished by constitutional anmendment No. 1 of 2005. The latter establishes the abolishment of special pensions, however, it does not define what is considered as such; nor have done so the norms that regulate the Social Security System in the country. Thus, there are different standpoints found in case law that generate uncertainty regarding the validity of the minimum pension guarantee for demobilized persons, as it is not clear whether this constitutes a special pension. The paper shows that one of the main characteristics of special pension schemes is that they are enshrined in rules other than Law 100 of 1993, which establishes the general system of social security in Colombia. Given that the minimum pension guarantee for demobilized persons is contained in such law and that neither the jurisprudence nor other rules have given it special character, this investigation leads to the conclusion that the demobilized pension was not abolished. From this perspective, the document analyzes the possible implications that the validity of the rule can lead to in Colombia considering the current post-conflict context. |
