Summary:While our health care system has many advantages, it presents a number of problems. This can be confirmed by the large number of health care tutelas that are filed every year, as their profuse interposition shows that users must resort to legal action in order to obtain complete attention. Now, the high costs of medicines in the national territory that make it difficult for EPS Health Promotion Entities to deliver them in a timely manner, may be the cause of the interposition of tutelas for the request of medicines. Within this framework, this investigation traces the impact that the regulation of drug prices has had on the number of tutelas filed for violations of the right to health. In order to do so, it also tracks the causes that lead to the filing of tutelas for medicines. To this end, the existing regulation is analyzed using the logic of the method of differences in differences and semi-structured interviews are conducted with different actors in the health system. As a result, the research shows that, presumably, the regulation that has been in place since 2016 has had an impact on the number of tutelas filed for drug-related issues and that the filing of tutelas for drug requests responds to a variety of causes, not only to regulatory omissions, which involve various actors in the health system such as the State, the EPSs, the Pharmaceuticals, the patients and the health service providers.
