La carga y los estándares probatorios en el Código Mundial Antidopaje : un análisis doctrinal y jurisprudencial

"The paper aims to analyze and determine who bears the burden of proof and the scope of the standards of proof contemplated in the article 3.1 of the World Anti-Doping Code of the World Anti-Doping Agency (WADA). Then, the article 3.1 of the World Anti-Doping Code determines that the standard of proof that the Anti-Doping Organization must reach should be to "the comfortable satisfaction of the hearing panel, bearing in mind the seriousness of the allegation which is made". It then establishes that the standard to which they must comply must be "greater than a mere balance of probability but less than proof beyond a reasonable doubt?. Therefore, once the Anti-Doping Organization presents evidence about a probable anti-doping rule violation, and/or when the Code itself places on an athlete, or any other person who has allegedly committed an anti-doping rule violation, the burden of reversing that presumption or of demonstrating certain facts or circumstances, the standard of proof that the athlete must reach is the -balance of probabilities-. Thus, it can be problematic that the Code determines standards of proof for the doping cases, under the understanding that if the scope of the them are unknown and, therefore, a proper definition is ignored, a decision in law could not be adopted in any proceeding initiated for a doping rule violation. For this reason, defining and determining the standards of proof contemplated in the article 3.1 of the World Anti-Doping Code, is essential for decision-making in the sports jurisdiction, for the respect for the fundamental rights of athletes and for the consolidation of the Code around the globe."
