Summary:From the point of view of critical feminism, the text will first seek to understand sexual harassment as a type of gender violence and the obligations of the States to prevent and eradicate it. In this way, the text will proceed to delimit and differentiate sexual harassment typified in the colombian Penal Code from sexual harassment that does not comply with this classification, specifically sexual harassment in public and semi-public spaces. The text will focus, then, on this last one in order to evaluate the proposal to penalize this type of harassment and that is why the next part of the writing will expose the specific reasons why it is considered that criminal law is not a suitable solution; on the contrary, its implementation would lead to the creation of measures without practical effects that would only increase a punitive environment in Colombia.
