Description
Summary:In the name of development, the realization of productive economic activities that destroy the environment and affect people's health have been allowed, among these are the productive activities of the primary sector of the economy. This activities carried out mainly in rural areas of the country, peripheral and isolated areas with low state institutions, which prevent effective control over environmental and labor law. From this context, it was decided to carry out a review of specialized literature and dogmatic-legal research based on jurisprudential investigations from 2010 to 2020, which allowed us to observe if there was a relationship between environmental pollution and labor informality in the development of these productive activities, and if the judges at the time of ruling took into account the relationship between both areas of law. In the document these problems are analyzed and it is concluded that the formalization of employment does not necessarily mitigate the environmental damage caused in the performance of these activities and that it is necessary that the environmental judgments take into account the worker who exploits the land informally, since most of them are economically and socially vulnerable people.
