Summary: | The inflexibility of the PPP regulatory framework has made it difficult for this mechanism to be implemented for the reactivation of the rail freight transport mode in Colombia, so the question arises: what adjustments should be made to the PPP regulatory framework to facilitate the performance of railway infrastructure projects for freight transport? This work will use the methodology of analysis of the case, specifically the Colombian,one under the normative and theoretical-practical perspectives, to answer the question posed through two normative proposals: (i) a decree that regulates the way in which they may be established functional railway units and under what conditions the remuneration tied to their partial availability may be agreed and (ii) a reform proposal to Law 1508 of 2012 regarding the percentage of participation of the Nation in private initiatives with public resources, in which eliminates the 30% limit for infrastructure projects for rail freight transport... |
