description The present article intends to meditate on one of the so many challenges for the rights and for the benefits of the citizenship: the use of the land, inclusive and agreed, in Mendoza’s County, Argentina. In populations, as the case of Mendoza, where the physical singularity and aridity of the floor condition the human establishment and the economic activities, the territory becomes a fundamental basic resource to protect, and its use and fair and equal distribution are vital for the local society. However, in the current social, political and economic context, the absence of normative, the public inaction and the scarce civic participation have favored a disordered urban growth and an inadequate use of the floor and of the infrastructure. Situations of social fragmentation, inequality and concentration of the socioeconomic and political processes are deepened. In the year 2006, the Legislature of the County begins the treatment of bills of floor use. Initially, the legislative debate generated favorable expectations in the citizenship, however, scientific, professionals and technicians noticed that the proposals had numerous technical and legal difficulties. The same ones committed the rational and inclusive use of the floor seriously. This way, a process of civic discussion the one begins which is analyzed in this article.

This way, a process of civic discussion the one begins which is analyzed in this article.En el presente artículo se propone reflexionar sobre uno de los tantos desafíos por los derechos y por los beneficios de la ciudadanía: el uso del suelo, inclusivo y consensuado, en la Provincia de Mendoza, Argentina. En poblaciones donde la singularidad física y aridez del suelo condicionan el asentamiento humano y las actividades económicas, como es el caso de Mendoza, el territorio se convierte en un recurso básico fundamental que se debe proteger, y su uso y distribución justa y equitativa resultan vitales para la sociedad local. Sin embargo, en el actual contexto social, político y económico, la ausencia de normativa, la inacción pública y la escasa participación ciudadana han favorecido un crecimiento urbano desordenado y una inadecuada utilización del suelo y de la infraestructura. Se profundizan situaciones de fragmentación social, desigualdad y concentración de los procesos socio-económicos y políticos. En el año 2006, la Legislatura de la Provincia comienza el tratamiento de proyectos de ley de uso de suelo. Inicialmente, el debate legislativo generó expectativas favorables en la ciudadanía, sin embargo, científicos, profesionales y técnicos advirtieron que las propuestas contaban con numerosas dificultades técnicas y legales. Las mismas comprometían seriamente la utilización racional e inclusivo del suelo.
