Un derecho a los alimentos y a los medios de desarrollo físico, psicológico de cada hijo sin una razón justificada porque la ley presume que el padre posee las capacidades económicas de un salario mínimo por lo tanto tiene la capacidad para responder y no faltar a la responsabilidad. En Colombia los jueces fallan en muchos casos basándose en presunciones sin llegar a conocer más allá los motivos del incumplimiento de la obligación, generando un posible fallo injusto para alguna de las partes. Por lo tanto en este artículo se busca conocer más a fondo la manera en la que los jueces están fallando en los casos de inasistencia alimentaria.

A right to food and the means of physical and psychological development of each child without a justified reason because the law presumes that the father has the economic capabilities of a minimum wage, therefore he has the capacity to respond and not lack responsibility. In Colombia, judges rule in many cases based on presumptions without knowing further the reasons for the breach of the obligation, generating a possible unfair ruling for one of the parties.
