Esta es la primera de las razones que nos motivó a trabajar en un tema poco común en el campo de las investigaciones de proyectos de grado de Derecho, pues logramos unir los conocimientos en ambas áreas (Aviación y Derecho) y pudimos ver con más amplitud las diversas ramas donde nuestra carrera hace presencia. La segunda razón que nos llevó a asumir esta investigación fue identificar el inconformismo que hay en la actividad de la aviación civil colombiana, toda vez que los pilotos vienen sosteniendo desde hace varios años una problemática de vulneración al derecho de pensionarse a una edad justa y coherente acorde al tipo de actividad que estos realizan; pues se observa que dicha labor menoscaba su salud. No pretendemos analizar la aviación como actividad de alto riesgo desde el punto de vista de los incidentes y/o accidentes aéreos; sabemos que en su mayoría son catastróficos y corren con un porcentaje mínimo de probabilidades de sobrevivencia cuando acontecen. Pero también sabemos que las probabilidades de que estos se presenten, son poco significantes. Analizaremos este tema desde el punto de vista de los factores de riesgo y lo que significa para la salud del piloto desarrollar dicha actividad y exponerse a dichos factores que logran menoscabar su salud.

This is the first of the reasons that motivated us to work on an unusual topic in the field of research for Law degree projects, since we managed to unite knowledge in both areas (Aviation and Law) and we were able to see more broadly the various branches where our career is present. The second reason that led us to undertake this investigation was to identify the nonconformity that exists in the Colombian civil aviation activity, since the pilots have been arguing for several years a problem of violation of the right to retire at a fair and consistent age according to the type of activity they carry out; as it is observed that such work impairs their health. We do not intend to analyze aviation as a high risk activity from the point of view of air incidents and / or accidents; we know that most of them are catastrophic and run with a minimal percentage of probability of survival when they occur. But we also know that the probabilities that these occur are not very significant.
