Acompañamiento jurídico de las organizaciones sindicales adscritas al centro de atención laboral cal, y estudio de la acción de tutela para la protección del derecho de asociación sindical

El objetivo general de este proyecto se basó en el acompañamiento jurídico de las Organizaciones Sindicales adscritas al Centro de Atención Laboral, CAL de Bucaramanga y el estudio de la acción de tutela como mecanismo para defender el derecho fundamental de Asociación Sindical. El desarrollo de esta práctica jurídica permitió comprobar, la gran problemática de los trabajadores sindicalizados, para defender sus derechos laborales, consagrados en diferentes normas de rango constitucional, legal y convencional, por medio de la proyección de diferentes acciones contempladas en el ordenamiento jurídico para ese propósito, la cuales fueron supervisadas por profesionales del derecho, a pesar de lo esto el uso de los mecanismos jurídicos, representa muchas veces el único medio idóneo disponible para defender el bienestar de los trabajadores que se encuentran en una situación de vulnerabilidad por la constante agresión de sus derechos, aunado al acompañamiento jurídico, realizamos diferentes jornadas de capacitación para diferentes grupos de trabajadores, en temas relacionados con el derecho laboral, la realización de acciones tipo para la protección del derecho de asociación sindical cuyo fin es de servir de herramienta que permita utilizar fácilmente esta acción, por parte de personas que no conozcan sobre este tema. Por último, realizamos un breve estudio de la acción de tutela, con base en diferentes fuentes de bibliográficas, y en especial los pronunciamientos de la Corte Constitucional, para conocer y determinar los alcances de esta acción constitucional, teniendo en cuenta los orígenes de esta, los principios normativos que la rigen, y el desarrollo en la casuística de la protección del derecho de asociación sindical, desde los casos relacionados con este tema, que logramos llevar dentro del marco de nuestra práctica

Moreover; through the use of different mechanisms established in the legal system with the purpose of looking after labor rights and the supervision of professional lawyers in the process; the development of this legal practicum shed light on the problematic that unionized workers have when defending their labor rights consecrated on the legal and conventional rules of constitutional status. Given the above; most of the time the use of legal mechanisms represents the only suitable means available to defend the welfare of the workers who find themselves in a vulnerable position due to continuous aggressions of their rights. Furthermore; we carried out a set of training journeys for different groups of workers; in matters related to labor law and the implementation of standard actions for the protection of trade unions rights with the purpose of easing the usage of tutelage actions as a tool for people who are not very knowledgeable on the subject. Finally; we directed a brief study on the tutelage action based on different bibliographical sources; especially on pronouncements of the Constitutional Court; to know and determine the scope of this constitutional action; considering the origins of this; the normative principles that govern it; and the development in the casuistry of the protection of trade union rights based on the cases related to this subject; that we manage to carry within the framework of our practice.
