Summary: | The National Penitentiary and Prison Institute (INPEC) is a public entity, attached to the Ministry of Defense, governed by parameters and norms regulated by the Political Constitution of Colombia and by other subsidiary norms. For its part, the La Modelo Penitentiary Center in Bogotá is part of INPEC, it has more than five thousand inmates; since 2019 it has remained overcrowded. This research, through the analysis of different articles, books, videos, jurists, Colombian jurisprudence and international treaties, identifies that the La Modelo prison fails to fully comply with the constitutional and legal principles of equality and respect for human dignity established in protection standards that cover the population deprived of liberty. However, the State, tending to guarantee the protection of the human rights of persons deprived of liberty, allows them access to the administration of justice to guarantee the prevalence of their rights, if they consider that there is any violation of their rights. ratified by Colombian law and international treaties. |
