La problemática que surge en el ordenamiento jurídico colombiano al no existir una prohibición expresa para la realización de este tipo convenios o acuerdos. Respecto de las técnicas de reproducción asistida, dentro de las cuales se ubica la maternidad subrogada o sustituta.
