Summary:The electoral void will be understood in the development of different constitutional rights such as the right to participation, the right to equality and the right to administration of justice in the Colombian electoral system taking within the civil service. The electoral void will be understood in the development of different constitutional rights such as the right to participation, the right to equality and the right to administration of justice in the Colombian electoral system taking within the civil service. The analysis is made on the historical context on the right of election in Colombia in the normative and social development, being linked with the creation and regulation of the Council of State Section Fifth, being the competent ones to know of said means of control established in the Code of Administrative Procedure and Administrative Litigation. In addition, the implications of international law as a guarantor of the protection of human rights will be demonstrated, a state integrated in the Colombian legal system as the figure of a block of constitutionality
