Description
Summary:In Colombia, from 2004 with the enactment of Law 906, a procedural criminal justice that are stuck elements of American adversarial criminal justice system, combined with entrenched European tradition elements, which marked the passing of it was established criminal justice Colombia in most of its history. As inferred, the adaptation of this system was not complete to the extent that it is not accurate reproduction of the American judicial model as the Colombian judicial system has very different nuances to the American as can be recognized in the comparison of its aspects organizational and institutional. However, one of the figures that probably is closer to this new adaptation refers to the figure of the jury, which was in force in the Colombian legal system for the first century of the Republic, then was suppressed, and was expected back his regulation by law 906 of 2004, to be revived as a legal institution in 2002 by Legislative Act 003, although the law in question did not advance more than mention it and leave the mandate for another time Legislator regulating it. Given the above, the current document is developed vindicating the figure of the jury, considering that for the same, it can give meaning to social justice and a level of representation to the public. Thus, the implementation of the document aims to present the points of discussion that must occur during their regularization, especially when they are exercising compared to the figure of the jury in the United States
