¿Cómo Incide la Implementación de las TIC en el acceso a la justicia en línea, a partir de la Entrada en vigencia del Decreto 806 del 2020?

This paper covers three main sections. In the first section, we discuss the use of Information and Communication Technologies (ICT) in the administration of justice. Addressing the background, the regulatory development and creation of the Ministry of ICT, determining the beginnings of virtuality in the administration of justice. In the second section, we analyze the content of Decree 806 of 2020, investigating the origin and the guiding principles through which ICTs govern. The priority of its implementation, the agreements issued by the Superior Council of the Judiciary, and the purpose of the Decree that implements the mandatory nature of virtuality in the development of judicial processes considering the Health Emergency caused/instigated/triggered by COVID - 19. In the third section, we explain the benefits and difficulties introduced by the Decree from a critical perspective. It addresses the issues related to the inoperability of the ICT implementation in the judicial system, the impact of digital transformation in the development of judicial processes, the different procedural changes that were adopted, and the resulting conclusions from the research that was undertaken.
